各債務整理のメリットとデメリット3
4つ種類が債務整理には有りますが、種類それぞれにメリット・デメリットが存在しています。ここでは「自己破産」における債務整理に関するメリット・デメリットに関して挙げてみたいと思いますので、自己破産をしようと考えているのであれば是非、参考にしてみて下さい。
≪メリット≫ ・自己破産手続きをすると、債務額が全額免除になり以降の支払い義務が無くなりますので、生活の再建がしやすくなります。
・手続きが出来る人の条件ですが、客観的に見ても支払い不可能と判断される様な人であれば誰でも手続きをする事が可能です。
・自己破産の申立をすると、債権者側による債務者への督促や請求が無くなります。
もしも自分でやるのではなくて司法書士や弁護士等専門家に依頼しているのであれば依頼した時点で請求や督促行為が無くなります。
その為、精神的にも楽になります。
≪デメリット≫ ・自己破産の手続きをするとブラックリストに一定期間（大抵は5〜7年程）載ってしまいし、その期間は借金やローンが組めない事になります。
・申立をして認められると官報と破産者名簿に載ってしまう為、第三者に知られる可能性が出てきます。
・マイホームや自動車等、原則として20万円以上の価値ある財産については処分されて、債権者側に公平に分配されてしまいます。
・債務の理由がギャンブルや浪費であるならば免責されない場合が有ります。
・自己破産をするには有る一定の資格や条件が必要になります。
